Terms and Conditions / Festival Regulations
1. General
Organizer:
The organizer of the CoSy Festival is Love Foundation e. V., represented by the Board in accordance with Section 26 of the German Civil Code (BGB).
The CoSy Festival is organizationally coordinated by an independent production structure.
The contract is concluded with Love Foundation e. V., represented by the Board:
Caroline Richter, Hans-Martin Wulfmeyer, Marcel Böge, Michael Gebhard, Philipp Gaestlin
In addition, persons who have been expressly and verifiably authorized by the Board of Love Foundation e. V. for the project are entitled to conclude contracts.
By purchasing tickets via the shop, the buyer bindingly accepts these Terms and Conditions as well as the Festival Regulations.
2. Purchase Agreement
By purchasing admission tickets or related services, a binding contractual relationship is established between the buyer and the organizer.
The offer to conclude a contract is made by fully and correctly entering all required data and submitting the order, or in the case of bank transfers, upon receipt of payment.
There is no right of withdrawal pursuant to Section 312g (2) No. 9 BGB, as these are leisure services provided for a specific date.
The total price is due immediately upon conclusion of the contract without deductions.
All ticket prices are final prices and include the applicable statutory VAT and, where applicable, advance booking fees. Additional fees may arise depending on the selected payment method. Shipping costs may be charged separately.
If paper tickets are offered, shipping is carried out at the buyer’s risk. The organizer’s liability is limited to the liability scope of the respective shipping service provider.
For international bank transfers, the buyer bears all applicable bank and transfer fees.
Each ticket is provided with an individual QR code. Admission is granted once per ticket number only. The QR code must be kept secure and serves as binding proof of entry.
Access to the festival grounds is permitted only to persons who have reached the age of 18 and only with a personalized ticket and presentation of a valid official photo ID. Data verification takes place at entry.
The commercial or private resale of tickets and complimentary tickets is prohibited. Violations will be prosecuted.
Refund
If the event is fully canceled by the organizer, the ticket may be returned within two weeks. In this case, the face value of the ticket will be refunded. Advance booking and system fees charged by external service providers are excluded from reimbursement.
In all other cases, particularly in the event of program changes, weather conditions, restricted visibility, or loss of the ticket, there is no entitlement to a refund.
3. Program Design
The organizer reserves the right to change the program, admission times, and program sequence at any time for objective reasons.
Responsibility for the content of individual program items lies with the respective participants. The content does not necessarily reflect the opinion of the organizer or its vicarious agents.
Due to volume levels, there is a risk of hearing damage. Each visitor is responsible for using appropriate hearing protection.
4. Audio, Image, and Film Recordings
Audio, image, and film recordings are permitted exclusively for private use, unless otherwise announced on site.
The publication of recordings of performing artists without their consent may have legal consequences.
Image Rights:
The visitor agrees to being photographed or filmed as part of the event. The resulting material may be used and made publicly accessible by the organizer and persons commissioned by the organizer for reporting, advertising, and documentation purposes.
This does not apply if legitimate interests of the visitor oppose such use.
5. Festival Grounds
Attendance on the festival grounds is at the visitor’s own risk.
Access is permitted only with the admission wristband issued at entry and exclusively via the official entrances. Persons without a valid wristband will be removed from the premises.
Security personnel are authorized to carry out entry and security checks, bag inspections, and body searches. Instructions from security personnel must be followed.
The organizer is entitled to refuse entry or remove visitors from the premises for objective reasons, in particular in the event of violations of the Festival Regulations or for security reasons.
Bringing glass containers, dangerous, bulky, or sharp objects, pyrotechnic items, weapons, and writing or spray materials relevant to property damage is prohibited. Alcoholic and non-alcoholic beverages in plastic or metal containers are permitted.
In the event of serious or repeated violations of the Festival Regulations, immediate expulsion and a ban from the premises may be imposed. In such cases, there is no entitlement to a refund.
Waste must be disposed of in the designated containers. Waste separation is marked accordingly.
Smoking is prohibited in indoor areas.
The festival takes place predominantly outdoors. Sheltered areas are only available to a limited extent.
6. Protection of Minors
The organizer follows the German Youth Protection Act. Access is restricted exclusively to persons who have reached the age of 18.
7. Liability
The organizer assumes no liability for lost or stolen items.
The organizer is liable for damages only in cases of intent or gross negligence. In cases of slight negligence, liability is limited to foreseeable damages.
Liability for damages resulting from injury to life, body, or health remains unaffected.
8. Validity, Data Protection, Applicable Law
Should individual provisions of these Terms and Conditions or the Festival Regulations be or become invalid, the validity of the remaining provisions shall remain unaffected.
Personal data is processed exclusively in accordance with applicable data protection laws. Processing takes place for contract execution and implementation of the event pursuant to Art. 6 (1) (b) GDPR.
The organizer’s Privacy Policy applies, available on the official festival website.
German law shall apply exclusively.
